1. Agreement and service
These terms apply to the UpDown website and community shared-ride application. The operator is identified in the policy panel. Read these terms, our Privacy Policy, Community Guidelines and Cancellation and cost-sharing policy before using ride features. Use of the service is subject to these terms and applicable law.
UpDown provides tools for people to find one another, offer planned journeys, request seats and communicate. Community members provide their own vehicles and make their own travel decisions. UpDown does not operate a vehicle fleet, employ community drivers or provide emergency response. A listing or accepted request does not guarantee that a journey will take place.
2. Eligibility and accounts
You must be at least 18 and legally able to enter an agreement to create an account or arrange a ride. Use accurate information and a phone number you control. Do not impersonate anyone, share an account, circumvent restrictions or create misleading verification claims. Protect your sign-in details and report suspected account misuse.
Drivers must hold a valid licence, be authorised to use the listed vehicle and comply with applicable registration, insurance, roadworthiness, seating and transport requirements. Listing a trip does not establish that every legal or insurance requirement has been checked by UpDown. Drivers are responsible for checking whether cost sharing is permitted for their vehicle and journey.
3. Listings, requests and journeys
Offer only journeys you genuinely intend to make. Provide accurate route, timing, pickup, vehicle, available seats and cost-contribution information. Keep listings current and communicate material changes promptly. Riders must review the complete details and request only the seats they need. A pending request is not a confirmed seat; check its current status.
Before departure, agree on the public meeting point, timing, luggage and contribution. Do not add passengers, change vehicles, substantially alter the route or increase an agreed contribution without informing affected travellers and obtaining their agreement. People remain free to decline a changed or unsafe journey.
Both parties must obey traffic laws, use required restraints, respect boundaries and avoid distracting the driver. Drivers must not drive while impaired, fatigued or otherwise unfit. No one may pressure another person into continuing a journey they consider unsafe.
4. Cost sharing and payments
The App displays split-fare information supplied for a journey. UpDown currently has no integrated payment checkout or wallet. Agree on the contribution and how it will be settled before travelling. Do not imply that UpDown holds, insures or refunds money exchanged directly between users. Any later platform fees or payment feature require clear disclosure and updated terms before use.
Use of cost sharing must comply with applicable transport, tax and insurance requirements. These terms do not authorise commercial passenger transport where it is unlawful or requires additional permissions. Cancellation and payment-dispute guidance is available in the Cancellation and cost-sharing policy.
5. Conduct and user content
Harassment, threats, discrimination, sexual misconduct, stalking, spam, fraud, illegal goods, unsafe journeys, rating manipulation and misuse of personal information are prohibited. Do not scrape user data, bypass access controls, interfere with the service or exploit security weaknesses. Report suspected vulnerabilities privately through the support channel.
You retain ownership of content you submit. You permit UpDown to store, process and display that content as needed to operate, secure and support the service, consistent with the Privacy Policy. Do not upload content you lack permission to use or confidential information that is unnecessary for a ride. Feedback must reflect your experience and must not expose another person's private information.
6. Verification and availability
Phone, email or other verification statuses indicate only the check described by the relevant feature. They are not a background check or a guarantee of future behaviour. Ratings and profile details can help inform your decision but may be incomplete or inaccurate.
Features and availability can change by location, device, service conditions and published community journeys. Maintenance, outages and cancellations may interrupt access. Keep a practical alternative for time-sensitive travel. External links and services have their own terms.
7. Reports, restrictions and appeals
Report account, safety and conduct issues through Contact with relevant ride details. For immediate danger in India, call 112. UpDown is not an emergency service.
Where appropriate and lawful, UpDown may investigate reports, remove content or restrict accounts for serious misuse, security concerns or breaches of these terms. Restrictions should be proportionate to the issue; immediate action may be necessary to protect people or the service. You may seek review through support and explain why you believe a decision was incorrect. We may preserve relevant evidence where required by law.
8. Responsibilities and liability
Travellers are responsible for their own choices, accurate information and conduct. UpDown remains responsible for obligations imposed on it by applicable law. To the extent law permits, the service is provided subject to operational limitations and UpDown does not guarantee ride availability, punctuality, participant behaviour or uninterrupted access.
Nothing in these terms excludes liability that cannot legally be excluded, removes mandatory consumer rights or prevents lawful remedies for fraud, negligence or other actionable conduct. No policy statement overrides a statutory obligation.
9. Intellectual property and ending use
UpDown branding, website materials and software are protected by applicable intellectual-property law. You may access them for lawful personal use of the service. Do not reproduce branding or software to impersonate UpDown or mislead users.
You may stop using UpDown at any time. Sign-out or uninstalling does not erase server-side records. See Data requests and account deletion for the current deletion process and limitations. Retention after ending use is governed by the Privacy Policy and applicable law.
10. Law, disputes and updates
These terms are governed by applicable Indian law, subject to mandatory protections that apply to you. Try to resolve service issues through support first. This does not prevent you from approaching a competent court, regulator or consumer forum with jurisdiction. No exclusive venue or mandatory arbitration requirement is imposed by these terms.
We may update terms as features or legal requirements change. The effective date appears above. Material changes require appropriate notice; any additional consent required by law must be obtained separately. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law.
